The Vermont Bean Guarantee

A credit voucher will be issued for any plant materials that fail to grow one time, provided we are notified by October 1 of the year of purchase and the item has been properly cared for and in the planting zone noted in the catalog. Annual plants such as tomatoes, peppers, and herbs are only guaranteed to arrive in good shape. If you have a problem upon arrival, please notify us immediately (within 10 days) so we can take care of the problem for you. We guarantee you complete satisfaction with our gardening supplies (non-growing items) when used according to the manufacturer's instruction. Report of unsatisfactory garden accessories must be reported within 30 days for a credit voucher or refund. Only manufacturer's guarantee (if any) applies after 30 days. We reserve the right to request return of the product deemed unsatisfactory prior to approval of any adjustment.
Our seeds are routinely tested to ensure they meet federal standards and packets are color coded to indicate seed lots. Unless otherwise noted, our seeds are untreated. On occasion, we are only able to supply treated seed of a variety.
We guarantee that the seeds we sell conform to the label description, as required by State and Federal Seed Laws, within recognized tolerances. We make no other guarantees, express or implied, of merchantability, fitness for purpose, or otherwise, of the seed or of the crops grown from the seed, other than germination. Our liability for the breach of this guarantee, whether contractual, for negligence, or for any other reason, is limited to either a credit voucher for the purchase price or replacement of such seeds one time, either act of which shall constitute full and complete adjustment and release. As a condition to any liability on our part, we must receive notice of any claim for defective seeds by registered mail within 30 days after the defect becomes apparent. We reserve the right to request the return of merchandise before making adjustments. Several states (AL, AR, FL, ID, IL, IN, MN, MS, ND, SC, SD, TX, WA or any other state which adopts arbitration or mediation laws) require arbitration or mediation before maintaining a legal action based upon failure of the seed sold to produce as represented. You must file a complaint (sworn if applicable), with any applicable filing fees, with the State Commissioner/Director/Secretary of Agriculture within such time as to permit inspection of the plants or crop by us and any designated agency. If this guarantee is not acceptable, then the seeds must be returned at once in the original, unopened container, and the purchase price will be refunded in full.
NOTE: Seeds are living products that depend on many factors such as proper planting time and technique, depth of sowing, soils, proper germination environment, fertility, disease control, insect control, and reasonable weather for direct sown seeds. If any of these factors are not right, it may cause the seed to not perform and because most, if not all, of these are out of our control, most of the success of these seeds is in the hands of the grower. If they have been cared for properly and still fail to grow, we will REPLACE the seed or ISSUE A CREDIT VOUCHER, one time. We guarantee that the seeds we sell conform to the label; however, our liability is limited to the purchase price of the seed.
Genetically Modified Seeds: To our knowledge, none of our products have been developed through the mechanical transfer of genetic material between genera, families or kingdoms.
Although every precaution is taken to ensure accuracy, errors in price, quantity and/or specifications may occur. We reserve the right to correct such errors.
